Last updated: 13.06.2025
1. General Information and Details on the Collection of Personal Data
1.1. We maintain a publicly accessible social media profile (hereinafter “profile”) on Facebook, Instagram, LinkedIn, TikTok and YouTube.
This privacy policy applies to the following social media presences:
• Facebook: https://www.facebook.com/myoactemg/
• Instagram: https://www.instagram.com/myoact/?hl=de
• LinkedIn: https://de.linkedin.com/company/myoact-gmbh
• TikTok: https://www.tiktok.com/@myoact
• YouTube: https://www.youtube.com/@myoact-emg
Further information on Facebook, Instagram, LinkedIn, TikTok and YouTube can be found under Section 6 (Social media presences in detail) below.
1.2. Visiting our profiles triggers various data processing operations. Below, we inform you which personal data we collect, process and store in this context. Personal data are those details that can be assigned to you as a specific person (e.g., name, age, address, photos, email addresses, possibly also IP addresses).
We also inform you about the rights you have vis-à-vis us regarding the processing of your personal data.
You are not obliged to provide us with your personal data. However, this may be required for certain functionalities of our profiles on social networks. These functionalities will not be available to you, or only to a limited extent, if you do not provide us with your personal data.
1.3. When you visit our profiles, your personal data are collected, used and stored not only by us, but also by the operator of the respective social network. This happens regardless of whether you are logged into your social network or not, and even if you do not have your own profile in the respective social network. In this case, data collection may occur, for example, via cookies stored on your device or by collecting your IP address.
Using the data thus collected, the operators of the respective social network can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you both within and outside the respective social network. We point out that social networks also process data based on your usage behavior within the respective platform or your other internet usage. If you have an account with the respective social network, interest-based advertising can be displayed on all devices on which you are or were logged in.
Please note that the individual data processing operations and their scope are not necessarily fully traceable to us. They differ depending on the operator of the respective social network. For details on the collection and storage of your personal data as well as the type, scope, and purpose of their use by the operator of the respective social network, please refer to the operator’s terms of use and privacy policies.
2. Controller contact details
2.1. The controller for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is MYOact GmbH, Kaiserstrasse 61, 60329 Frankfurt am Main, Germany, Telephone: +49 (0) 69 – 24751025, Email: info@myoact.de. The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.
2.2. When you visit one of our profiles, we and the operator of the respective social network are joint controllers for the data processing operations triggered by this visit. You can generally assert your rights (access, rectification, erasure, restriction of processing, data portability and complaint) both against us and against the operator of the respective social network.
Please note that despite joint controllership with the respective operator of the social network, we do not have full influence over the operator’s data processing operations. Our options are largely determined by the corporate policy of the respective operator.
3. Data processing when contacting us
If you use our profiles on social networks to contact us (e.g., by creating your own posts, reacting to one of our posts, or by sending us private messages), the data you provide will be stored and used exclusively for the purpose of responding to your inquiry and for the related technical administration. The legal basis for processing the data is our legitimate interest in responding to your request pursuant to Art. 6(1)(f) GDPR. If your contact aims at the conclusion of a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR. Your data will be deleted after final processing of your request unless statutory retention obligations conflict with this. We consider processing to be final when the circumstances indicate that the matter in question has been conclusively clarified.
4. Rights of the data subject
4.1. As the person affected by the processing of your personal data, you can assert certain rights against the controller.
4.2. You have the right
– pursuant to Art. 15 GDPR to obtain information from us about the processing of your personal data;
– pursuant to Art. 16 GDPR to obtain without undue delay the rectification of inaccurate personal data concerning you and/or the completion of incomplete personal data;
– pursuant to Art. 17 GDPR to obtain the erasure of personal data concerning you without undue delay;
– pursuant to Art. 18 GDPR to obtain restriction of processing;
– pursuant to Art. 20 GDPR to receive the personal data concerning you, which you have provided to us, in a structured and machine-readable format and to transmit those data to another controller;
– pursuant to Art. 21 GDPR to object at any time, on grounds relating to your particular situation, to processing of personal data concerning you where the processing is based on an overriding interest or your data are used for direct marketing purposes;
– to withdraw your consent to data processing at any time without affecting the lawfulness of processing based on consent before its withdrawal;
– to lodge a complaint with a supervisory authority about our processing of your data.
5. Duration of storage of personal data
We delete the data collected and stored about you via the social network as soon as storage is no longer necessary or you ask us to delete them. The same applies if the purpose of storage ceases to apply (e.g., if you object to direct marketing, Art. 21(2) GDPR). If you have consented to the processing of your personal data (Art. 6(1)(a) GDPR), the data affected by this will be stored until you withdraw your consent. Stored cookies remain on your device until you delete them. In the case of statutory retention obligations, we restrict the processing of the stored data accordingly until the respective retention period expires. If our data processing was based on our legitimate interest (Art. 6(1)(f) GDPR), your personal data will be stored despite an objection (Art. 21(1) GDPR) as long as we can demonstrate a compelling legitimate interest that overrides your rights and freedoms, or the processing serves the establishment, exercise, or defense of legal claims. We have no influence on the storage period of your data stored by the operators of the social networks for their own purposes. For details, please consult the operators of the social networks directly (e.g., in their privacy policies; see below).
